Terms & Conditions

In the context of our sales and/or rental business, we offer you the designated property as well as our services as agents.

§ 1 Liability for offers
Since the offer is based on information and documents provided by the relevant client / customer, despite all care and attention we are unable to guarantee the completeness and correctness of this information. Liability for the correctness and completeness of the content of the information provided is therefore explicitly excluded.
Liability for gross negligence or wilful intent remain unaffected.
Offers are without obligation and non-binding. We in particular explicitly reserve the right to a prior sale and/or a prior rental.

§ 2 Disclosure of offers
The content of this offer is confidential. You may therefore neither disclose the offer nor details thereof to third parties without our written authorisation.
The marketing materials for our sale and rental properties are protected by copyright.
In the event of the disclosure of the offer without our written authorisation, the recipient of the offer is obliged to pay the full commission amount if the third party to whom the agent information was disclosed concludes the transaction.
The copyright for published material created by the author belongs solely to the author.
The duplication or use of graphics, audio and video files and texts in other electronic or printed publications is not permitted without the explicit and written authorisation of the author.

§ 3 Dual agency
We are also entitled to act for the other contractual party subject to commission.

§ 4 Claim to commission
4.1 Accrual of the claim to commission
The claim to commission exists and is earned as soon as a contract is concluded, in the case of a sales contract upon signature of the notarised contract, as a result of our information or agency activities.

4.2 Amount of the commission
The commission rates stated in the property advertisement apply. Differing conditions must be confirmed by us in writing.

4.3 Continuance of the claim to commission
The claim to commission continues even if the concluded contract expires as a result of the occurrence of a dissolving condition and/or is not executed by the contractual parties.
The claim to commission also continues if, instead of the originally intended transaction, a different transaction occurs (e.g. purchase instead of rental), insofar as the economic result does not significantly differ from our offer.

§ 5 Responsibility for costs at contract conclusion
All costs related to the conclusion of the contract are borne by the purchaser.

§ 6 Jurisdiction
The place of jurisdiction is Hamburg, Germany.

§ 7 Severability clause
Should individual provisions of these Terms & Conditions be or become invalid, the remaining provisions shall remain unaffected.
